1. About Us

These terms and conditions ("Terms") govern your use of the website at draftfc.co.uk and any associated applications ("Service") operated by Draft FC Ltd ("we", "us", "our"), a company registered in England and Wales under company number 14295934.

2. Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Notice. If you do not agree to these Terms, you must not use the Service.

You must be at least 18 years of age, or at least 16 years of age with parental or guardian consent, to register for an account and use the Service.

3. Definitions

"Account" means the personal account you create to access the Service. "Content" means all data, analytics, predictions, text, images, and other materials available through the Service. "Digital Content" has the meaning given in the Consumer Rights Act 2015. "Subscription" means a paid plan that grants access to premium features of the Service.

4. The Service

Draft FC provides fantasy football analytics, data, predictions, and tools designed to help users make informed decisions in fantasy football draft leagues. The Service is classified as digital content within the meaning of the Consumer Rights Act 2015.

Certain features of the Service are available free of charge. Access to premium features requires a paid Subscription.

The Service relies on data from third-party sources, including the Fantasy Premier League (FPL) API. We do not control these third-party sources and cannot guarantee their continued availability or accuracy.

5. Account Registration

To access certain features of the Service, you must create an Account. You agree to:

• provide accurate and complete registration information;
• maintain the security of your password and Account;
• notify us promptly of any unauthorised use of your Account;
• accept responsibility for all activity that occurs under your Account.

You may not share your Account credentials with any other person, and each Account is for a single individual only. We reserve the right to suspend or terminate any Account that we reasonably believe is being shared or used in breach of these Terms.

6. Subscriptions and Payment

6.1 Subscription Plans

We offer several Subscription plans, the details of which (including pricing and billing frequency) are set out on our website at the time of purchase. All prices are stated inclusive of VAT where applicable.

6.2 Payment

Payments are processed securely through our third-party payment provider, Stripe. By subscribing, you authorise us to charge the applicable fees to your chosen payment method. We do not store your full payment card details on our systems.

6.3 Automatic Renewal

Recurring Subscriptions (such as our Monthly Pass) will automatically renew at the end of each billing cycle unless you cancel before the renewal date. We will charge the then-current Subscription fee to your payment method on file. You may cancel automatic renewal at any time through your Account settings or by contacting us.

6.4 Price Changes

We may change our Subscription prices from time to time. If we do, we will give you at least 30 days' notice before any price increase takes effect. If you do not agree to the new price, you may cancel your Subscription before the price change takes effect.

6.5 Failed Payments

If a payment fails, we may retry the charge and/or suspend your access to premium features until payment is successfully processed. We will notify you of any payment failure and give you a reasonable opportunity to update your payment details.

7. Cancellation and Refunds

7.1 Immediate Access and Cooling-Off Period

When you subscribe, you expressly request and consent to immediate access to the Service. By doing so, you acknowledge that you lose your right to cancel under the 14-day cooling-off period provided by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, as the supply of digital content begins immediately upon Subscription.

7.2 Cancellation

You may cancel your Subscription at any time. Cancellation will take effect at the end of your current billing period. You will continue to have access to premium features until the end of the period you have already paid for. No refunds will be given for the unused portion of a billing period.

7.3 Our Right to Cancel

We reserve the right to cancel or suspend your Subscription and/or Account at any time if you breach these Terms, engage in abusive or fraudulent conduct, or if we reasonably believe your continued use of the Service poses a risk to us, our systems, or other users. Where we cancel your Subscription due to your breach, you will not be entitled to a refund.

If we cancel or discontinue the Service for reasons other than your breach, we will provide a pro-rata refund for any unused portion of your Subscription that has been paid for.

7.4 How to Cancel

You can cancel your Subscription by emailing us at info@draftfc.co.uk or through your Account settings. We will confirm your cancellation by email.

8. Your Rights Under Consumer Law

Under the Consumer Rights Act 2015, digital content supplied must be of satisfactory quality, fit for a particular purpose, and as described. If the digital content does not meet these standards, you may be entitled to a repair, replacement, or a price reduction. Nothing in these Terms affects your statutory rights as a consumer.

9. Acceptable Use

You agree not to:

• use the Service for any unlawful purpose or in violation of any applicable law or regulation;
• scrape, crawl, or use automated means to access or extract data from the Service, except through any APIs we expressly make available;
• reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying data models of the Service;
• reproduce, redistribute, sell, sublicence, or commercially exploit any Content or data obtained from the Service;
• interfere with or disrupt the integrity or performance of the Service or its underlying systems;
• impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity;
• attempt to gain unauthorised access to any part of the Service, other users' Accounts, or any systems or networks connected to the Service;
• use the Service in any manner that could damage, disable, overburden, or impair our servers or networks.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including suspending or terminating their Account and reporting them to the relevant authorities.

10. Intellectual Property

All intellectual property rights in the Service and its Content, including but not limited to software, algorithms, data compilations, analytics, text, graphics, logos, and design, are owned by Draft FC Ltd or our licensors and are protected by copyright, database rights, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service and its Content for your personal, non-commercial use only, subject to these Terms. This licence does not include the right to copy, modify, distribute, sell, or create derivative works from any Content.

Certain data displayed through the Service is sourced from third parties, including the Premier League. Such data remains the property of the respective rights holders.

11. Disclaimers

The analytics, predictions, statistics, and other information provided through the Service are for informational and entertainment purposes only. They do not constitute financial advice, gambling advice, or any other form of professional advice.

While we endeavour to provide accurate and up-to-date information, we do not warrant or guarantee the accuracy, completeness, or reliability of any Content, predictions, or analytics. Fantasy football outcomes are inherently unpredictable, and past performance is not indicative of future results.

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or free from viruses or other harmful components. Scheduled maintenance, third-party service outages, or other factors beyond our control may affect availability from time to time.

12. Limitation of Liability

Nothing in these Terms excludes or limits our liability for:

• death or personal injury caused by our negligence;
• fraud or fraudulent misrepresentation;
• any breach of your statutory rights under the Consumer Rights Act 2015; or
• any other liability that cannot be excluded or limited under applicable law.

Subject to the above, we shall not be liable to you for:

• any indirect, incidental, special, consequential, or punitive damages;
• any loss of profits, revenue, data, goodwill, or business opportunity;
• any loss arising from your reliance on any analytics, predictions, or other Content provided through the Service;
• any loss arising from the inaccuracy or unavailability of third-party data, including data from the Fantasy Premier League.

To the fullest extent permitted by law, our total aggregate liability to you in connection with the Service shall not exceed the amount you have paid to us for your Subscription in the 12 months immediately preceding the event giving rise to the claim.

13. Suspension and Termination

We may suspend or terminate your access to the Service immediately, without prior notice, if we reasonably believe that you have breached these Terms, or if we are required to do so by law.

Upon termination, your right to use the Service will cease immediately. Any provisions of these Terms that by their nature should survive termination shall continue in full force and effect, including but not limited to provisions relating to intellectual property, limitation of liability, and governing law.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Service and cancel your Subscription.

15. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, pandemic, internet or telecommunications failures, power outages, or the failure of third-party services (such as the Fantasy Premier League API or our hosting providers).

16. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, nothing in this section affects your right to bring proceedings in the courts of your country of residence, or to benefit from the mandatory consumer protection provisions of the laws of that country.

17. General Provisions

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

These Terms, together with our Privacy Notice, constitute the entire agreement between you and Draft FC Ltd in relation to your use of the Service, and supersede all prior agreements, understandings, and arrangements between us, whether written or oral.
